Discrimination can be a big concern for many U.S. immigrants. However, there are federal laws specifically designed to protect immigrants during the hiring process and beyond.
Employers are not allowed to discriminate against employees due to citizenship or immigration status. Furthermore, employers also are prohibited from retaliating against a worker who files a charge of discrimination or participates in a workplace investigation.
Employers cannot request employment authorization prior to when an immigrant accepts a job. Employers also cannot refuse to accept authorization documents or not hire an applicant solely because they are not a permanent resident or citizen.
When immigration and employment law converge, issues can become complicated. We believe all immigrants should understand their rights under both federal law.
