Child Custody and Relocation

Clients are usually looking for a fresh start after a divorce, sometimes involving a move out of state.

When trying to move a child out of North Carolina, the most important issue is whether courts in the state have jurisdiction over the child under the Uniform Child Custody Jurisdiction and Enforcement Act.

If the child’s home state is North Carolina, the courts here have jurisdiction over a child and custody matters involving the child.

If North Carolina is your child’s home state and you have a child custody agreement, the agreement will govern your ability to relocate. If you do not have a child custody agreement relocating the child out of state without securing the written consent of the child’s other parent poses risks and complex legal issues. If the current agreement prohibits moving the child out of state, you can speak with your attorney about seeking modification. Moving your child out of the state without written permission from the other parent or court approval, the other parent could be awarded emergency custody by the court. And in future proceedings, the fact that you moved the child without permission could be a significant disadvantage.

If you petition the court for permission to relocate a child, you must be prepared to demonstrate that moving the child is in the child’s own best interests. Talk to your attorney about your reasons for relocating and they can assist you with compiling the required evidence in preparation for your case.
